Working Time Directive (Drivers Hours)
The Working Time Directive (Drivers Hours) is a peice of leglslation that still 8 years after it implementation that still confuses people!!
The Basics
- This is a peice of EU legslation (EC Regulation 561/2006)
- The legslation limits the amount of time that can be worked for mobile workers
- A mobile worker is some one who drives for their work
- Your are ony exempt if you work less then 10 days in the 26 week reference period
- There is NO OPT-OUT of this leglslation
- The scope limits "working time" to an average of 48 a week over the reference period
- There is also a limit of 60 hours "working time" in any single week with the proviso that the 48 hour averge is maintained
- What is "Working Time"
- Working time is defined as any activities carried out in connection with the transport operation count as work
- This means that for an HGV Driver, "Driving" and "Other Work" count as "Working Time"
- "POA" and "Rest" periods are not counted as "Working Time"
- The Directive also stipulates breaks needed. This does not superseed the drivers hours rules but runs alongside.
- Basicly whichever break time falls due first then a break must be taken and timers reset.
- If you are working up to 6 Hours then a 15 Minute break must be taken.
- If your are working between 6 and 9 Hours then a total of 30 minutes must be taken.
- If you are working longer than 9 hours then a total of 45 minutes must be taken
- Breaks must be taken in a minimum of 15 minute periods and cannot be taken at the end of the shift as you walk out the door!!
- Rember under driver hours law that if breaks are split the second must be of a minimum of 30 minute duration.
